Court documents reveal that investigators discovered surveillance video, cellphone data and witness accounts that tie Fernandez to the killing.

The site reports that L&B Spumoni Gardens pizzeria owner Louis Barbati was gunned down in the backyard of his Brooklyn home in June after arriving home from work with a large sum of cash. The shooter, who waited in the home, was dressed in all black and fired five shots before fleeing the scene without the money. Police officials are claiming that this was a robbery job gone wrong.

While the state is prepared to carry out their case against Fernandez, an attorney for the Barbati family released a statement sharing the family's current sentiments.

"The loss of Louis Barbati leaves a void that will never be filled, however the fact that someone is being brought to justice aides in the healing process."

There is currently no word on Fernandez entering a plea anytime soon. The site has contacted his lawyer, Avrom Robin, but he has not responded.
