If the jury decides to waive the death penalty Jodi Arias will be sentenced to life in prison. It is possible she could go for parole in 25 years, but that is a decision the judge will make.

On May 8, 2013 Jodi Arias was convicted of killing her on again off again boyfriend Travis Alexander. When she was first questioned about Alexander's murder, Jodi Arias denied having been at his home the night he was killed. Once the police began to press Arias harder, she admitted she was there the night her lover died.

Arias still denied any involvement in Alexander's death. She told police she watched as two masked men killed Alexander and left her alive, fearing for her life. When that story fell apart Arias finally admitted she was the one who stabbed, shot and slit the throat of Travis Alexander.

Arias claimed she murdered her boyfriend in self-defense and not in cold blood. The police, the Alexander family and the jury did not believe Arias' tales of domestic abuse and battery on the part of Travis Alexander.

The jury agreed it was first degree murder on May 8, but could not make a decision regarding the death penalty. The judge thanked them for their service and decided a new jury would be brought in to try and decide the fate of Jodi Arias.

Originally the jury was supposed to be given instructions about making this decision and hear testimony and evidence starting July 18. Today the defense is asking them to first make the decision as to whether or not Jodi Arias qualifies for the death penalty before taking her life into their hands.
