The killing of Kayla Gomez-Orozco has shattered the state of Texas and the nation. The Mexican man who is charged with her murder, a close relative, has been in the country illegally.

According to KETK, Gustavo Zavala-Gomez, has been in the Unites States illegally and had previously been deported for a violent crime in 2014. Records also show that he was arrested for assault causing bodily injury twice in 2014. Now, he is currently in custody and has been charged with capital murder for killing his younger cousin.

Smith County Sheriff Larry Smith tells the network that the body of the 10-year-old was found in a well Saturday night. The pre-teen went missing after a Tuesday November 1st church service at first Assembly of God in Bullard, about 15 miles south of Tyler. Family members revealed that hse got bored and left the room to wait in the lobby but when her mother went to chekc on her she vanished.

Smith said the child's body was found through an investigative lead. After obtaining a search warrant, investigators determined her remains were in a well near a family member's home at the location off the 22000 block of Old Jacksonville Highway. She was still in the clothes she was last seen in when Tyler Fire crews helped recover the body, after midnight.

Zavala-Gomez is currently being held on a U.S. Immigration and Customs Enforcement (ICE) detainer. He is currently in the Smith County Jail. At this time no bail or bond has been set.

Police officials are currently still searching the residence and vehicles at the location for more evidence.

Authorities are currently waiting from results of the autopsy to further conclude if more charges will be filed.
