A 37-year-old dismissed police officer who was accused of assaulting a 14-year-old school student in 2016 and leaving him severely injured has been sentenced to three years of rigorous imprisonment.

On Jan. 22, 2016, the accused, Shailesh Kadam was at his home in Dadar, Mumbai, India when he looked through his window and saw a boy leaning on his scooter that he had parked near a bus stop.

Kadam yelled at the minor before rushing down and bashing him. The victim was left with a bloody nose and mouth.

“The grievance is serious as the accused was a police personnel and it was his duty to protect the helpless, children, and needy persons,” Metropolitan Magistrate, Pravin P Deshmane said during the sentencing, adding that the accused brutally assaulted the child over a trivial issue without even considering his age.

The victim told the court that he leaned on a scooter parked on the footpath since there were no seats at the bus stop. He said the accused abused him and brutally assaulted him and when his friend tried to intervene, the man threatened to chop him to pieces.

The incident came to light after the boy went home and narrated his ordeal to his father, who took him to the police and filed a complaint against the officer.

According to court records, the accused officer was suspended in 2015, after he allegedly misbehaved with a lady officer and when confronted caused damage to the official property and brandished a knife to intimidate officers at the Juhu police station.

The court also pointed out that the accused had been booked in several molestation cases in the past.

“These cases are sufficient to show the criminal tendency of the accused to use force and misbehave,” the court said.

Adding to the three-year rigorous imprisonment, the magistrate also fined the accused Rs 50,000 ($668) of which Rs 25,000 ($334) will be given to the teenager as compensation for the mental trauma he had to go through.
