They tried to make her go to rehab, but she said no, no, no. The only problem is that if Lindsay Lohan doesn't start her 90-day treatment, she might be going to jail. Again.

After making everyone believe she was "serious" about her recovery this time around and even instagramming more than 200 outfits she was going to wear in her three months retreat, LiLo never made it to Morningside Recovery in Newport Beach.

The New York Daily News reported that Lohan never stepped foot inside Morningside, and instead went shopping for electronics in a store nearby. Her father, Michael Lohan that he had to stop his daughter from taking a flight back to New York. He also said Lindsay "was not happy with the place".

The real problem was when LiLo's attorney, Mark Heller assured Superior Court Judge James R. Dabney at the hearing that the actress was getting settled in at the center. "My client is ensconced in the bosom of that facility right now," Heller argued after a prosecutor objected to Lohan's choice of rehab facilities. "She's in rehab right now. Nothing bad is going to happen."

Judge Dabney said during the morning hearing that based on the letter from Morningside, --that stated that the clinical team is highly specialized in the treatment of substance abuse and the psychiatric illnesses of individuals suffering from chemical dependency issues-- it appeared to meet the requirements of Lohan's sentence in the case filed after the actress crashed her car in June while on the way to a film shoot. Dabney agreed that Lohan should remain at Morningside.

Hours after the hearing, Millicent Tidwell, acting deputy director of licensing and certification for the California Department of Alcohol and Drug Programs said Morningside is not licensed to perform residential in-patient rehab or addiction treatment and lacked the appropriate license to provide residential treatment or recovery programs.

The facility is certified to provide outpatient services and operates sober living houses, which do not require licenses. "If a 24-hour residential facility is providing treatment or services to promote the recovery of alcohol and drug abuse then they must possess a license," said Tidwell.

Lohan's choices are not clear, but returning to Morningside might avoid immediate arrest since the judge did give tentative approval of the facility and he warned her that any future probation violation will send her directly to jail, with no more chances to avoid doing time.
