For many people who are still wondering the status of the investigation into Jose Fernandez’s death, it is coming to a close. It has been reported that investigators have received the toxicology report.

According to the LA Times, a spokeperson from the Florida Fish and Wildlife Conservation Commission says that the agency has “received the report” from the Miami-Dade medical examiner’s office. However, they are declining to release the results of the tests.

FWC spokesperson Rob Klepper has declined to release or discuss the tests due to the active investigation of the crash still going on. The Miami-Dade State Attorney’s Office, however, says it isn’t involved in any criminal investigation given that everyone involved in the crash was killed.

Fernandez along with his two friends, Emilio Macias and Eduardo Rivero were killed early morning on September 25. The boat crashed around 3:15p.m. Earlier that morning, the three men were seen at American Social Bar & Kitchen.

With the news and the toxicology report, it is being speculated that the men were intoxicated which more than likely led to the unfortunate incident.

The site reports that The Herald requested the test results because they should show whether any among the trio drank alcohol or used any number of common drugs the night or the fatal boat crash.

According to investigators, the boat was severely damaged due to the crash and was later towed away to a secure facility for a detailed inspection.

The DailyMail reports that officials are currently trying to determine who exactly was piloting the boat at the time of the accident.

Lorenzo Veloz of the FWC says that speed was a factor in the accident.

“It does appear that speed was involved due to the impact and the severity of it, Veloz tells the publication. “It does appear to be that they were coming at full speed when they encountered the jetty, and the accident happened.”
