A woman who was in attendance during the 2021 Astroworld Festival in Texas has filed a lawsuit against rapper Travis Scott after she claims that she lost her baby during the concert that killed over ten people and injured hundreds of others.

Ohio residents Shanazia Williamson and her husband Jarawd Owens filed a lawsuit in December against Scott, promoter Live Nation, and others involved in the festival saying that she was trampled during the festival which caused her to lose her baby, Rolling Stone reported.

“While in attendance at the festival, Shanazia was trampled and crushed resulting in horrific injuries and ultimately the death of her and Jarawd’s unborn child,” the suit said. “In addition, Shanazia sustained injuries to her shoulder, back, leg, chest, stomach and other parts of her body.”

Among the other claims that Williamson’s team has is their belief that Travis Scott’s team was negligent in how they ran the festival, because of how they ignored the safety hazards that the festival had and because of their failure to set-up proper medical personnel in the area, according to the New York Post.

“Defendants’ failure to plan, design, manage, operate, staff, and supervise the event was a direct and proximate cause of Shanazia’s injuries and death of her and Jarawd’s unborn child,” the lawsuit said.

The status of a fetus as a claimant in a wrongful death suit varies from state to state, but in Texas, the Civil Practice and Remedies code specifically includes fetuses from the moment of fertilization as defendants of a wrongful death suit, although there is very little precedent for the case due to most of it being solved by settlements.

“...[When] we’re talking about a wrongful act that results in the loss of a pregnancy, the pregnant person’s interests align with a fetal interest, and it’s in the interests of the mother to have people not commit wrongs against the fetus that she’s carrying,” law professor Elizabeth Sepper said.

Neither Scott nor any of the other defendants have commented on the lawsuit as of this time.
