Kourtney Kardashian has been hit hard with a paternity suit. The reality star is facing a lawsuit from a model who claims that he is her son Mason's biological father. The model, Michael Girgenti has filed paper work at a Los Angeles County Superior Court to get joint custody of Kardashian's 3-year-old son Mason. TMZ reported that for the pending law suit, a judge has now ordered DNA tests for Kourtney Kardashian, her son Mason, and her longtime partner, Scott Disick. Disick is the father of Kourtney's youngest child, Penelope, who is only a year old. And while a hearing has been set for next month, simply by the striking resemblance between Mason and his father, Disick, most likely the paternity tests will rule in favor of Kardashian and Disick.

So who is Michael Girgenti and why is he attempted to claim joint custody of Mason Disick 3 years later?

1. Michael Girgenti is 26-years-old and he is a Los Angeles based model. Girgenti claims that he met Kourtney in 2008 when they posed together in a photoshoot for 944 magazine. He also states that the two then hand a 3-month texting relationship following the initial meeting.

2. Girgenti claims that he and Kourtney engaged in a physical relationship while she was on a "break" from boyfriend Scott Disick. "We started kissing, making out and touching each other. We were fooling around on the couch for a little while before I took her to the bedroom," Girgenti tells In Touch.

3. In addition, the model alleges that the unprotected sexual encounter happened exactly 9 months before she gave birth to her son Mason. "After he was born and I saw photos of him, I began to wonder," Girgenti says.

4. Girgenti has apparently been warning Kourtney regarding his intentions to file a paternity test for 3-year-old Mason. According to Perez Hilton, Girgenti sent Kourtney a letter in which he demanded a DNA test. In the letter, Girgenti wrote, "This is Kourtney's last chance ... My next step will be to take her to court and sue her for a paternity test. I'm tired of not knowing if Mason is my child, and I want the constant wondering to end."
