A 35-year-old Indian man who spent 3 years in jail for raping and impregnating a 13-year-old girl was acquitted after DNA results proved that he was not the father of the aborted fetus.

According to the court records, the case was registered on January 19, 2018, after the teen girl consulted a doctor complaining that she was not getting her periods.

Doctors examined the child and learned that she was four months pregnant. They immediately informed the minor girl’s parents.

The girl told them that she used to visit a friend’s place to play games on her tablet where a man, she identified as Nadim, had raped her three to four times between September and October 2017.

The child’s family filed a police complaint and the minor girl underwent an abortion at the Sion Hospital in Mumbai, India.

Based on the teen girl’s statement, the police arrested a suspect by the same name. He was presented before the court where he repeatedly claimed that he was being falsely accused and in no way connected with the case.

The suspect’s DNA samples were sent for forensic analysis to match with that of the aborted fetus.

Judge Priti Kumar Ghule observed, "DNA report which is a vital document to establish the paternity of the fetus of the victim doesn't determine the accused as the biological father. It is clear that the accused has not caused the minor girl's pregnancy."

Acquitting him, the court said, "It is clear that the testimony of the witnesses creates doubt as it is not contradicted by the DNA report. There is the involvement of some another person to cause pregnancy is clear."

"The prosecution has failed to prove that the accused is the person who committed the offense. It is clear that some other person is involved who has established repeated sexual intercourse and caused the victim's pregnancy," the judge said.

The judge further noted that the police has not been able to identify the person who had committed the crime.
