
A Texas woman spent five months in prison for miscarrying inside a restaurant bathroom stall before her charges were dismissed last week.
On Dec. 18. 2024, Mallori Patrice Strait entered a Whataburger fast food chain's bathroom around 2 a.m. Several hours later, an employee called police after seeing a baby's body in the toilet of a stall occupied by Strait, News 4 San Antonio reported.
The 33-year-old mother and the baby, later determined to be a girl, were taken to a nearby hospital where the 30-week-old baby was pronounced dead. Strait was detained and charged with abuse of a corpse.
Her legal team's motion to dismiss the charged, filed at the Bexar County District Attorney's Office on May 14, was accepted by a district court judge after the office determined there was insufficient evidence to prove Strait's "voluntary and knowing conduct damaged the fetus," KSAT reported.
The medical examiner's office determined Strait had a miscarriage and the fetus was "non-viable." The baby's death could not be linked to any particular cause, according to KSAT. Although the fetus had a damaged skull, the district attorney's office stated it is a common occurrence during miscarriage or birth.
