Arizona police have recommended criminal charges against Brady Kiser, the husband of influencer Emilie Kiser, nearly two months after their 3-year-old son Trigg drowned in the family's backyard pool.

The tragic incident occurred on May 12, in Chandler, Arizona, while Brady was home alone with Trigg and the couple's newborn, People reported. According to police records, Brady told investigators he briefly lost sight of Trigg while caring for the infant.

When he returned to check the backyard, he found Trigg unresponsive in the pool. Emergency responders transported the toddler to Phoenix Children's Hospital, where he died the following day.

After a nearly two-month investigation, the Chandler Police Department submitted the case to the Maricopa County Attorney's Office on July 15, recommending a Class 4 felony charge of child abuse against Brady. Police allege Brady was negligent in supervising Trigg, noting in search warrant filings that he was aware the child had been playing near the pool and that the cover was not in place. Surveillance footage from the home was reviewed to verify Brady's account.

The Attorney's Office is now reviewing the case to determine whether to move forward with charges or drop the matter. In parallel, Emilie Kiser filed a lawsuit in late May to block public access to investigative records, citing privacy and the intense media attention surrounding the case.

On June 3, a court granted temporary confidentiality for Emilie's personal statement and other sensitive documents. Though no final ruling has been made on whether to release footage of the incident, the case has ignited debate about privacy rights for public figures, especially in the aftermath of personal tragedy.

More than 100 public records requests have reportedly been filed for footage of Trigg's death. Investigators from both the Chandler Police and Medical Examiner's Office have requested access to sealed documents to conclude their reviews, but a court decision on that request remains pending.
