A mom who tried ways to abandon her children is seeking to enter an insanity plea. Brittany Gosney was indicted last month in connection with the death of six-year-old James Hutchinson who the mother tried to leave and abandon at the Rush Rush Park in Preble County, Ohio.

It was in February when the 29-year-old mother attempted to abandon James and his two siblings. And just when Gosney thought that she was successful, she was unaware that the child held on to the car as she was driving away.

She brought the body of James back to her home but was pressured by her boyfriend, James Hamilton. The 42-year-old wanted Gosney to abandon the children.

With her efforts failing, Hamilton reportedly helped Gosney dump the body of the injured six-year-old in the Ohio River near Lawrenceburg, Indiana. The two other children were left unharmed.

Police grew suspicious of the couple who reported James Hutchinson missing to Middletown police on Feb. 28. The couple gave conflicting information which led authorities to become suspicious. In the end, Hamilton confessed to the killing of Hutchinson and eventually admitted that they dumped the boy’s body in the Ohio River.

Gosney was indicted with 16 counts that included murder and abandonment. Hamilton was also indicted on 15 counts in connection with the first grader's death. He has pleaded not guilty.

"[Gosney] struggles to assist in her defense, and counsel has serious concerns regarding defendant's mental health," her attorney, David Washington, wrote in a motion filed in Butler County Court on Wednesday.

Washington is also requesting leave to file a plea of not guilty because of insanity and ask for a competency evaluation. Gosney and Hamilton are scheduled to next appear in court on March 22.
