A second mystery driver involved in the road rage shooting incident in Lake Shore Drive last Tuesday is still at large. The Chicago Police Department said they have arrested Jushawn Brown, 43, who was driving the vehicle in which the critically injured 21-month-old baby was riding.

According to police reports, Brown was driving his car on Lake Shore Drive about 11:30 am and shots were fired between his car and an SUV.

Prosecutors said while Brown was driving, the other vehicle attempted to merge onto the highway and nearly struck Brown’s car. Brown pulled over to yell at the driver and the two drivers exchanged words until the SUV driver allegedly pulled out a gun and showed it to Brown and asked him, “What he wanted to do about it.”

Brown allegedly took out his own gun and placed it on his lap and tried to drive away from the SUV, but it kept following him. Contrary to initial police reports, prosecutors said there was no evidence that Brown fired his weapon or displayed it during the road rage incident.

The SUV driver allegedly fired shots at Brown’s car near the Shedd Aquarium and struck his car several times. One of the bullets went through the rear passenger window where the child was seated and struck the toddler’s head, The Chicago Sun Times reported.

Brown continued to drive north until he lost control of his car and crashed

He told the officers about his gun which he kept for protection and allowed the officers to take the loaded 9 mm handgun from him. The shell casings recovered at the scene of the shooting did not match Brown's gun. However, he was arrested that day and charged with unlawful use of a firearm by a felon and possessing a weapon without proper state identification. He was later released from custody on a $500 bond.

Prosecutors said the driver of the SUV has not been taken into custody as police continue to investigate the case.

Meanwhile, Brown’s attorney asked that her client be released on his own recognizance, saying he appeared to be a very “honest gentleman.” Judge Charles Beach said that because there was no indication that the driver of the SUV even knew Brown had a weapon worked in his favor. However, the judge said Brown should have to post some money to be released, citing that the class 4 felony Brown faces is a serious offense.

Brown is expected back in court Wednesday.

Dr. Marcelo Malakooti, the hospital's associate chief medical officer and medical director of its pediatric ICU informed that the injured child is on a ventilator and in a medically induced coma to protect his brain. "The fact that he hasn’t worsened, I would say, provides us with a cautious hope," he said at a news conference on Wednesday.
