Republican Rep. James Comer, chair of the House Oversight Committee, issued a subpoena to former President Joe Biden's doctor after he refused to appear before the body citing legal and ethical obligations as well as "physician-patient privilege."

Comer claimed that Dr. Kevin O'Connor played a role in "the cover-up of President Joe Biden's cognitive decline and potentially unauthorized issuance of sweeping pardons and other executive actions."

The committee went on to say that Comer requested O'Connor "appear voluntarily for a transcribed interview," but he refused, and also asked for him to "appear for a transcribed interview to discuss his medical assessments and involvement in the Biden family's influence peddling racket, but the Biden White House blocked his testimony."

Comer is focusing specifically on O'Connor's assessment in 2024 that the former president was a "healthy, active, robust 81-year-old male, who who remains fit to successfully execute the duties of the Presidency.''

Republicans have heavily challenged such assessments, especially after the release of a book by journalists Jake Tapper and Alex Thompson which detailed concerns about Biden's mental fitness and attempts from top aides to hide it from lower-level staff.

In this context, the committee claims O'Connor's role is key for its investigation. "Given your connections with the Biden family, the Committee sought to understand if you contributed to an effort to hide former President Biden's fitness to serve from the American people. You refused the Committee's request. However, to advance the Committee's oversight and legislative responsibilities and interests, your testimony is critical. Accordingly, please see the attached subpoena for testimony at a deposition on June 27, 2025," the document adds.

President Donald Trump has repeatedly made reference to Biden's cognitive abilities at the end of his presidency, recently suggesting key immigration policies may have been signed without his awareness.

As well as the book, Biden's health became a renewed point of controversy after his recent diagnosis with advanced prostate cancer. In the wake of this news, critics and political opponents have questioned how much of the administration's agenda was managed directly by Biden himself.

Trump alleged that Biden may not have knowingly authorized immigration legislation that contributed to border policy changes.

"Who signed legislation opening our border? I don't think he knew," Trump said, referencing the use of an autopen—a mechanical device sometimes used to sign documents on a president's behalf. He continued, "Who was operating the autopen? This is a very serious thing."
