The man who is facing multiple charges for attacking the husband of House Speaker Nancy Pelosi was illegally staying in the United States according to sources.

David Wayne DePape is facing several federal and local charges for attacking Paul Pelosi with a hammer. But it appears his case has become even more complicated following reports that he overstayed his visa and was technically in the country illegally, the Post reported.

It was added that the 42-year-old was originally born in Canada in 1980 and came to the United States as early as 2001 per sources. He had a valid Social Security number, something that can only be obtained if an individual has a job.

Further, the Social Security number was reportedly obtained in Hawaii. What remains unclear right now is how long DePape stayed in the country past the legal threshold.

DePape is being charged by the San Francisco District Attorney’s Office with attempted murder, assault with a deadly weapon and other criminal counts. He was also charged federally with attempted kidnapping and assault.

It was added that the 42-year-old had broken into the home of Pelosi. The House Speaker was in Washington at the time of the incident and DePape found her husband at home.

According to court documents per a report by CBS News, DePape had intended to kidnap the House Speaker and possibly break her kneecaps.

According to San Francisco District Attorney Brooke Jenkins, DePape’s actions were a result of a politically motivated attack.

“Since the horrific attack on Paul early Friday, we have been deluged with thousands of messages conveying concern, prayers and warm wishes. We are most grateful,” Nancy Pelosi said in a statement on Monday, Oct. 31.

“Thanks to the excellent team at Zuckerberg San Francisco General Hospital, Paul is making steady progress on what will be a long recovery process,” she added.
