A federal judge issued a furious 17-page order rejecting a request to deny due process to immigrants from the Trump administration's legal team.
U.S. District Judge Brian Murphy criticized the administration for violating a preliminary injunction he had issued, using their lawyers' own words to indicate that they had been insincere when arguing that immigration proceedings could be conducted outside of the country meaningfully.
The order, issued by Judge Murphy, demanded that Immigration and Customs Enforcement (ICE) allow deportees being sent to a country they don't hail from to state their concerns in court. Trump administration attorneys have stated that these arguments can be heard after deportation has already occurred.
"Since that hearing, merely five days ago, Defendants have changed their tune," Murphy wrote. "It turns out that having immigration proceedings on another continent is harder and more logistically cumbersome than Defendants anticipated."
"However, the Court never said that Defendants had to convert their foreign military base into an immigration facility; it only left that as an option, again, at Defendants' request," Murphy continued. "The other option, of course, has always been to simply return to the status quo of roughly one week ago, or else choose any other location to complete the required process."
Judge Murphy, who reiterated that deportees should be allowed to argue against their deportation before it occurs, further stated that the Trump administration mischaracterized his instructions in an attempt to avoid implementing the order.
"Defendants have mischaracterized this Court's order, while at the same time manufacturing the very chaos they decry," Murphy wrote. "By racing to get six class members onto a plane to unstable South Sudan, clearly in breach of the law and this Court's order, Defendants gave this Court no choice but to find that they were in violation of the Preliminary Injunction."
